Placing an Order
The purchase of products through the Website is strictly limited to parties who can lawfully enter into and form contracts in accordance with the laws of the State of California.
- Valid Age. You may only make purchases through the Website if You are eighteen (18) years of age or older.
- Provide Personal Information. In order to make a purchase on this Website, You will be required to provide Your personal details, including but not limited to Your legal name, phone number, e-mail address, and other requested information indicated at the time of order (the “Order”). You represent and warrant that all personal information is valid and correct, and You confirm that You are the person referred to in the information provided.
iii. Valid Address. Purchases will only be shipped to a valid mailing address that matches Your billing address, is found in the databases of our couriers, and that is otherwise deemed acceptable by ERL in our sole and absolute discretion. Please refer to the additional terms related to the purchase, billing, and shipping of any product, below.
- Authorization to Conduct Credit Check. Anti-Fraud, and Other Verifications. By making a purchase, You expressly authorize us (and our third-party service providers) to perform credit checks, authentication of Your identity and address, and to conduct anti-fraud and other verifications.
- Other Consents. By making purchases, You expressly consent to the terms and conditions in the “Purchase Limitations and Restrictions”, below.
Purchase Limitations and Restrictions.
Without limiting the generality of any other section of this Order and Terms of Sale Policy, ERL reserves the right:
- To limit or refuse any Order You place with us. Purchases on this Website are limited as follows:
- Certain products, including but not limited to Limited Edition items, Handmade goods, and other special releases, are subject to unique purchase limits. These limits may vary based on product availability, demand, and the nature of the item. The specific limitations for each product will be clearly detailed on the product’s page at the time of release.
- Purchases of quantities in excess of the above, whether in a single or multiple transactions, will be canceled. These restrictions may include Orders placed by or under the same account, the same credit card, and/or Orders that use the same billing and/or shipping address.
- Notwithstanding Subsection (i), above, from time to time, Limited Edition (“Limited Edition”) products may also be offered on this Website. These Limited Edition products may be subject to certain limitations and restrictions, as determined by ERL at the time of offering.
- To verify the validity of all Orders and/or cancel any Order if we find evidence of fraud, tampering and/or any other violation of the terms and conditions of this Agreement.
- To cancel or refuse any Order You place with us that does not satisfy our Payment Method and Verification policy (as provided below).
- To cancel or refuse any Order You place with us that does not satisfy our Order and Terms of Service Policy, including but not limited to false or multiple request or notices for return or refunds.
- To refuse any request to customize or alter any Order after such order has been placed or delivered.
- To limit, restrict, or refuse any sale, product offerings, or shipments of items purchased through the Website, in our sole discretion, based upon territories (domestic and international). In the event that we are unable to or choose not to ship an item, You will be notified accordingly and the amount for that item charged in relation to Your Order will be refunded accordingly.
Pre-Orders
From time to time, we may offer products on a “pre-order” basis. Pre-ordered products may be subject to additional terms and conditions, including delivery times, geographic restrictions, or the like. By Your placement of an order for any such products, You agree to those pre-order terms. You will also be required to pay in advance the full amount due as a deposit, inclusive of shipping fees, taxes and import duties, as applicable.
Marketplace Products and Sales.
From time to time we may offer collaboration products, select artwork and other third party products through our Website (“Marketplace Products”). Our Services may also include features that enable You to contact and communicate with us or our marketplace sellers (“Marketplace Sellers”) about the Marketplace Products listed on our Website. In such event, you acknowledge and agree that:
- You may be required (at our sole discretion) to provide additional information and/or to meet additional eligibility requirements (including, without limitation, financial information) before being permitted to do so.
- In addition to our standard Order and Terms of Sale Policy, additional terms and conditions may apply to Marketplace Products. It is Your responsibility to read them carefully before buying, bidding on, inquiring about any Marketplace Products available on the Website.
iii. As a marketplace, unless otherwise agreed to or noted in writing, we do not own, take title to, have possession of, or sell the Marketplace Products listed, marketed, offered or sold on or in connection with our Services (whether online or offline). We do not sell Marketplace Products on behalf of the seller. All Marketplace Products is offered for sale and sold directly from the seller to the buyer, and we are not a party to any sale. We do not transfer, and are not responsible for transferring, legal ownership or physical possession of Marketplace Products from the seller to the buyer.
- We may facilitate communication or payment between buyers, prospective buyers, bidders, and sellers in connection with some property. However, such Services are offered for convenience only. We have no agency authority and are not the agent of any buyer, prospective buyer, bidder or seller for any purpose. Our involvement in any sale transaction is limited to providing this marketplace, and, in some cases, accepting payment from the buyer on behalf of the seller in connection with the sale of some property. We may, but are not obligated to, provide intermediary services between buyers, prospective buyers, bidders, and sellers in connection with customer service or dispute resolution matters. In the event we elect in our sole discretion to provide intermediary services, we will attempt to help you resolve disputes in good faith and based solely on our interpretation of our policies, in our sole discretion; we will not make judgments regarding legal issues or claims. Our decision is final and binding on all parties and cannot be appealed, challenged or reversed.
- We do not endorse or control and are not responsible for the conduct (whether online or offline) of any buyer, prospective buyer, bidder or seller. We make no representations or warranties as to the character, reputation, policies or practices of any buyer, prospective buyer, bidder or seller. We make no representations or warranties that any buyer, prospective buyer, bidder or seller will complete any transaction or otherwise perform as promised (whether or not we collect or agree to collect payment from any buyer on behalf of any seller).
- We do not endorse or make any representations or warranties of any kind, express or implied, with respect to: (i) Marketplace Product listings on our Services, whether as to accuracy, completeness, truthfulness, reliability or otherwise; or (ii) any Marketplace Product listed, marketed, offered or sold (whether online or offline) by any Marketplace Seller and/or third party, whether as to quality, size, condition, description, provenance, attribution, authenticity, legality, merchantability, fitness for a particular purpose, or otherwise.
vii. No statement made by any Marketplace Seller about any Marketplace Product (whether orally, in writing, on our Services or otherwise) will be considered a representation, warranty, or assumption of liability of any kind by us.
viii. We reserve the right, at any time at our sole discretion, to refuse to list, de-list, or delay or suspend listing of any Marketplace Product on our Services. We will not be liable to any user for doing so.
- We may receive a commission from some sellers on some sales, subject to separate agreements between us and those sellers.
Cart, and Electronic Transmissions.
- Items in Cart. Please note that merchandise is only held for You once You have completed Your Order. Adding an item or items to Your shopping cart (“Cart”) does not reserve such item(s) for You or guarantee that You will be able to purchase such item(s) at a later date. An item can sell out while it’s sitting in Your Cart. If an item was removed from Your Cart, this may mean that we have sold out prior to You completing Your Order. ERL reserves the right, in its sole and absolute discretion, to change the prices offered on the website at any time, including without limitation, items that have been placed in Your Cart.
- Electronic Transmissions. The transmission of data or information over the internet or other forms of networks may not be secure, and is subject to possible loss, interception or alteration while in transit. ERL does not assume any liability for any damage You may experience or costs You may incur as a result of any electronic transmissions over the internet, other forms of networks or otherwise while using a Website. In no event will any information You provide on or through a Website be deemed to be confidential, create any fiduciary obligations to You on our part, or result in any liability to You on our part in the event that such information is inadvertently released by us or accessed by third parties without Your knowledge or consent.
Product Information; Prices; and Currency.
- Not Responsible for Errors. Information (including, but not limited to, information relating to product descriptions, pricing, promotions, offers, and/or availability) provided by ERL in relation to the Website is believed to be accurate at the time of publication. However, there may sometimes be information on the Website that contains typographical errors, inaccuracies, or omissions. We reserve the right, in our sole and absolute discretion, to correct any such errors, inaccuracies or omissions and to change or update information or cancel Orders if any information on the Website is erroneous or inaccurate at any time without prior notice (including after You have submitted Your Order).
ii. From time to time, we may modify, vary or withdraw (on either a permanent or temporary basis) some of the products and services and/or the features and specifications of those products and services, that are displayed on or made available to you through the Website, or make changes to the applicable prices for any such product or services, without notice.
iii. Product Color and Characteristics.
- Pictures of the products displayed on the Website are for illustrative purposes only. Although we have made every effort to display the products accurately, we cannot guarantee that a device’s display of our products accurately reflects them. In particular, the colors, fabric, shade, grain, texture of the products shown on your screen may vary from those on the actual product. Therefore, you should rely exclusively on the description of the products and their characteristics as mentioned on the Website.
- Many of our products are handmade, dyed and/or use natural products (such as leather). Variations in the texture, color, natural markings or irregularities of natural products (such as leather or fabric) are inherent to the product and not defects. In addition, please note that color transfer and fading may occur with fabrics such as denim or dyed fabrics. Care should be taken to avoid color transfer in the maintenance of the product.
- Product Prices. ERL makes every effort to ensure that the prices and items listed on the Website are up to date and correct. However, the prices and items listed on the Website are NOT guaranteed and are subject to change without notice. When item and/or price changes are made, those changes may not be immediately reflected on the Website. ERL posts changes to the Website as often and as quickly as possible in light of our business priorities, but sometimes these postings may be delayed. In such cases, ERL reserves the right to change item availability and selection, and/or the prices that accompany those items.
v.. Currency. ERL utilizes certain third-party services to provide product prices in Your local currency. The local currency calculations are based upon those prices set by ERL in United States Dollars. Please be aware that fluctuations in currency exchange rates will affect the product prices in Your local currency. In addition, as part of the conversion process, third-party service providers may round Your local currency price to adjust for the fluctuating currency exchange rate and conversion fees.
Payment Method; Verification; Remedies for Non-Payment.
- Payment of Orders. You have a legal obligation to pay for any Orders made by You. By completing an Order through the Website, You are agreeing to pay, in full, the prices and all applicable taxes and specified shipping and handling and other fees in relation to Your Order, either by credit card or other permitted payment method. Payments are processed by a third party service provider and ERL does not collect Your financial information. ERL will only charge You the invoiced amount, but Your financial institution may charge You a service charge or other bank fees.
- Time of Billing; Taxes, and Other Fees. You will be billed for Your Order at the time Your Order is placed. With respect to any auction purchase, upon conclusion of the auction sale, you will be billed for the total purchase price. You will be entirely responsible for all applicable taxes related to Your Order (e.g. sales tax, use tax, VAT, Internet sales tax and/or any other taxes or levies that ERL is required to collect from You) under Applicable Law at the time You are billed. Taxes may depend on delivery location.
iii. Change of Payment Methods. ERL reserves the right, in its sole and absolute discretion, to change the permitted methods of payment, including without limitation, the credit cards and/or other types of payment options we are able or willing to accept, at any time. If complete payment for Your Order is not received and verified by us, Your Order will not be processed. If You do not complete or improperly complete Your Order, it may not be accepted or acknowledged.
Verification of Payment Information and Orders by ERL .
- In order to complete an Order through the Website, You may be required to provide certain additional information that is required to process Your Order. For example, You will be required to provide valid payment information (e.g., a valid credit/debit card number and expiration date) to facilitate payment of Your Order. You confirm that the credit/debit card that is being used, as applicable, is Yours or that You have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card purchases are subject to validation checks and authorization by the card issuer. If the issuer of Your payment card refuses to authorize payment to ERL , we will not be liable for any delay or non-delivery.
- All Orders are subject to verification by ERL at any time and for any reason. We reserve the right, in our sole and absolute discretion, to require proof of identity in a form acceptable to ERL (i) to verify the legitimacy of any Order and/or other information; (ii) to verify that Your address matches the databases of our couriers; and/or (iii) for any other reason we deem necessary for the purposes of fulfilling an Order. In order to help protect You and ERL from fraudulent transactions, we may provide Your transaction-related information to a reputable third party organization to perform verification.
Remedies for Non-Payment.
Except as otherwise specifically provided herein, if for any reason you cancel any payment made by credit card or otherwise fails to pay the total purchase price with respect to any products in accordance with these terms and conditions, or other listed terms identified in the product listings, you will be in default ("Buyer Default") and will be liable for payment of such total purchase price and any other applicable charges. In the event of Buyer Default in connection with any products, without limiting any other rights or remedies available to us or the seller (whether at law, in equity, or under these terms), subject to the Uniform Commercial Code, the we may cancel the sale of such property to the defaulting buyer and resell such property publicly or privately on terms the seller thinks fit, and the defaulting you will be liable for payment of any deficiency between the resale price obtained by the seller and the purchase price originally owed by you. In any case, you will be liable to us, for any and all costs, expenses (including reasonable attorneys’ fees), and damages of whatever kind incurred in connection with such Buyer Default, the collection of any amounts due from you. In addition, if you for any reason fail to pay the total purchase price with respect to any products in accordance with these Order and Terms of Sale Policy and the Terms of Services, Section 5, you irrevocably authorizes us, at our option, to charge you for any outstanding portion of such total purchase price using any credit card information you have provided on the Website or in connection with the purchase, whether or not you provided such credit card information in connection with the sale at issue.
Acknowledgment of Product Uniqueness and Variation
ERL takes pride in the unique craftsmanship of our clothing items. Many of our products are created using processes that introduce slight, inherent variations in each piece. As a result, each item we sell may have unique characteristics, contributing to its distinctiveness.
- Variation as a Feature: Customers should be aware that such variations are an integral feature of the product and not a defect. These variations may include, but are not limited to, slight differences in color, texture, or pattern.
- Non-Conformity Clause: The presence of such inherent variations shall not be considered as non-conformity under the terms of the EU Consumer Directive 2019/771. Our commitment to quality and customer satisfaction remains, and this aspect of uniqueness is celebrated as part of our brand ethos.
- Customer Expectations: We endeavor to accurately represent our products in all marketing materials. However, customers are encouraged to appreciate and embrace the individuality of each item they purchase.
- Customer Acknowledgement: By purchasing from ERL, customers acknowledge and agree to the unique nature of our products.
Warranty and Conformity of Goods
At ERL, we endeavor to ensure the highest quality of our products and are committed to resolving any issues related to product conformity promptly and efficiently. Our warranty terms are designed to comply with Directive (EU) 2019/771 for our EU customers, as well as relevant consumer protection laws in the United States, and beyond.
- Scope of Warranty: This warranty applies only to products purchased directly from ERL or our official website. It does not cover products purchased from third-party retailers or resellers. For products purchased through these channels, please refer to the warranty information provided by the respective retailer or reseller.
- For EU Consumers:
- Definition of Non-Conformity: In alignment with the EU Consumer Directive 2019/771, "non-conformity" of clothing products offered by ERL is defined with the understanding that many of our items are crafted through processes that naturally result in variations, making each piece unique. Despite these inherent variations, the following criteria are used to determine non-conformity::
- Representation with Variations: While each clothing item is unique due to our manufacturing process, non-conformity occurs if the item significantly deviates from the description, images, or models provided. This considers the expected range of variations in color, texture, and finish that are a hallmark of our brand's products.
- Completion of Delivery: Non-conformity includes instances where the item is delivered without essential components, accessories, or accompanying items as described, despite the expected unique characteristics of each product.
- ii. Right to Redress for Faulty Goods: If you receive goods that are faulty or not as described, please inform us immediately. You have the right to notify us of any defects in the products within two (2) years from the date of delivery, as per the Directive (EU) 2019/771. This period may vary in specific EU member states.
iii. Remedies for Non-Conformity: If a product is found to be non-conforming, you are entitled to repair, replacement, a price reduction, or a full refund, including shipping costs.
- iv. Notification Period: Notify ERL within a reasonable timeframe after discovering any defects.
- For US Consumers:
- Warranty Period: Our products come with a warranty period of [specify period, e.g., one year] from the date of purchase. During this period, if any defects arise under normal use, you are entitled to a repair, replacement, or refund, subject to our warranty terms.

iii. Conditions for Complaint Acceptance: ERL shall refuse any complaint for Products that have been used contrary to their intended use.
- Additional Commercial and Consumer Guarantees: Any commercial and/or consumer guarantee provided by ERL is in addition to and does not affect your legal rights under the applicable law.
- Product Complaints and Contact Procedures: Any complaint regarding the Products in their current form and without relation to the delivery must be submitted by e-mail to the address help@erl.store followed by a written confirmation sent by registered letter with acknowledgement of receipt to the customer service at the following address help@erl.store
ERL | E-Commerce Shipping Policy
Shipping Policy Generally.
We will arrange for shipment of the products to you using a shipper of our choice from the shipping options at checkout. You will pay all shipping and handling charges unless otherwise specified in the order confirmation. Title and risk of loss pass to you upon our transfer of the products to the carrier/delivery. Shipping and delivery dates are estimates only and cannot be guaranteed. We are not liable for any delays in shipments.
You are responsible for complying with all of the applicable laws and regulations in your country, including the laws and regulations regarding the import of products into your country. You will be the importer of record of products shipped to you from outside of the country to which such products are shipped. By placing an order, you acknowledge that for any products shipped to you from outside of your country, you are importing the products in your order for non-commercial (personal) use. You agree that we may appoint a subcontractor (e.g. carrier/customs broker) on your behalf as your unpaid agent for customs purposes by executing a power of attorney applicable to a single non-commercial shipment.
For products imported into the United States, your order serves as your electronic signature indicating your agreement to the following statement: “The designated carrier/customs broker is hereby authorized to execute, as an unpaid agent who has knowledge of the facts, pursuant to the provisions of section 485(f), Tariff Act of 1930, as amended, the consignee’s and owner’s declarations provided for in section 485 (a) and (d), Tariff Act of 1930, as amended, and to enter on my behalf or for my account the goods described in the attached invoice which contains a true and complete statement of the facts concerning the shipment.”
You are responsible for any and all taxes, duties, and fees that may be due in relation to your order Your authorization permits the carrier/customs broker to act as your agent with the relevant customs and tax authorities in the destination country, to clear your merchandise, process and remit any taxes, customs duties and fees levied by the destination country.
For multiple product orders, we will attempt to ship all products contained in the order at the same time. Products that are unavailable at the time of shipping will be shipped as they become available. You will only be charged for products contained in a given shipment, plus any applicable shipping charges. You will only be charged for shipping at the rate quoted to you on your purchase receipt. The entirety of this shipping charge may be applied to the first product(s) shipped on a multiple shipment order.
Your order will ship as it becomes available, and our order processing company will make reasonable efforts to ship your order as quickly as possible. There may be times when a product you have ordered is out-of-stock, which will delay fulfilling your order. You will be informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment. In such instances of delay or back-order, you may cancel your Order at any time prior to shipping. We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by us only as an estimate. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability.
We will endeavor to charge you for all applicable sales taxes; however, it is your responsibility as the customer to report any purchases of tangible personal property that have not been taxed by us and pay the sales or use tax on those purchases unless exempt under applicable law.
ERL | RETURN POLICY
- General Return Policy: Except as otherwise provided herein, we have a 14-day return policy, which means you have 14 days after receiving your item to request a return.
- Custom Orders, Limited Editions, Final Sales Policy: All custom order, limited edition and/or final sale products, underwear, socks and jewelry are non-cancellable, non-returnable, and non-refundable, and sold “As-Is” and the general return policy shall not apply, except in the sole discretion of ERL.
- Permitted Returns. Notwithstanding the General Return Policy, we shall have the sole discretion to elect whether to refuse any return request, inspect the item that is the subject of a return request (for which you shall incur any expense of return to us for such inspection), or honor the return request (a “Permitted Return”). If we grant a Permitted Return, we may elect, in our sole discretion and subject to availability, to replace the Permitted Return with available inventory of the same product, provide you credit, or refund the purchase price you paid for the product (inclusive of the initial standard delivery charge, or if part of a larger order, the standard per item delivery charge). For those Permitted Returns, we will not refund the shipping costs to return the Order. In addition, as it relates to all Orders, any Permitted Return that: (x) is not in its original condition and original packaging (or re-packaged in accordance with the Return Shipping Guidelines (below); or (y) which we reasonably believe has been damaged by You, will not be accepted by us. Permitted Returns shall include only:
- Damaged Items. Only those items purchased by the original purchaser and received by the original purchaser in damaged condition from our manufacturer are capable of being deemed a Permitted Return. We do NOT consider the packaging or box part of the item in making this determination, and we will not offer refunds or replacements for any damage to such packaging or box. You shall notify ERL of receipt of any damaged item no later than five (5) days after delivery of the item to You (the “Damage Notice Period”) by sending notice to service.erl.studio, including (i) a description of the damage; (ii) photograph of the damaged item; and (iii) copy of the original receipt. Any notification or request by You beyond the Damage Notice Period shall be refused and rejected. Please be advised that due to the limited and special nature of the items, we may not be able to replace the item.
- Wrong Color, Wrong Size, or Wrong Item. If You receive the wrong color, wrong size, or wrong item You purchased, please notify us at no later than five (5) days after delivery of the item to You to service.erl.studio, including (i) a description of the item intended for purchase; (ii) photograph of the item received; and (iii) a copy of the original receipt (the “Wrong Color/Size/Item Notice”). Any notification or request by You beyond the Wrong Color/Size/Item Notice Period may be refused or rejected, in our sole discretion. Please be advised that due to the limited and special nature of the items, we may not be able to replace the item. We can only accept exchanges from the country in which the shipment was sent. In addition, please note that customized items cannot be returned or exchanged. With respect to handmade, dyed, or specially produced products, variations in the texture, color, fading, color transfer, natural markings or irregularities of natural products (such as leather) are inherent to the product and not defects, and cannot be returned or exchanged on such basis. You are responsible for ensuring that the customization details are correct. No cancellation nor alteration may be made once a customized order has been placed. It is not possible to request customization for items after an order has been placed or delivered.
iii. European Union Consumer Rights Directive. Where the EU Consumer Rights Directive (2011/83/EU) as implemented into national law in the various EU jurisdictions applies to You, unless one of the exceptions below applies, You have the right to cancel its order without giving reason within 14 days from the day on which You receive the Order. You must inform ERL of Your decision to cancel the order in writing within this period. Upon receipt ERL will reimburse all payments received from You for the Order purchased and You will incur no fee as a result of such reimbursement. However, reimbursement may be withheld until ERL has received the Order(s) back from You. You must send back the Items following the instructions of ERL. You will bear the cost of returning the Order to the Seller. You may lose this right if the value of the Order(s) returned diminishes due to the handling of the Order. The right of cancellation does not apply to: (a) the supply of Items made to the buyer’s specifications (You are responsible for ensuring that the customization details are correct. No cancellation nor alteration may be made once a customized order has been placed. It is not possible to request customization for items after an order has been placed or delivered.); (b) the supply of Items which may deteriorate or expire rapidly; (c) the delivery of Items which are not suitable for return due to health protection or hygienic reasons if unsealed by the buyer after delivery, or which are, after delivery, mixed with other items; (d) the delivery of sealed video or audio recordings or of sealed software if unsealed by the buyer after delivery; (e) final sale, Limited Edition and Handmade specialty products, where in the setting aside stock that would result in difficulty to fulfill.
- Return of Shipments By Shipping Carriers For Non-Acceptance or Wrong Address. In the event Your Order is returned to us by a shipping carrier based upon Your failure to sign for the shipment and/or “return-to-sender wrong address,” Your Order will be canceled, and You will receive a refund (less all expenses related to shipping and duties and a 5% fee restocking fee on the Order).

For Online Returns Processing:

- Access your order history to request a return or exchange for any unwanted items.
- Select and pay for a return label.
- For international orders: complete customs forms at zero value and clearly indicate your package as a RETURN.
- Pack the item(s) in their original shipping box or a sturdy carton box.
- Seal the box securely with tape.
- Affix the return information label and a prepaid return shipping label over the previous delivery details on the box.
- Contact the carrier to arrange a collection or drop your package at a pick up point
For E-Mail Returns:
- Your email subject should contain the following: RETURN REQUEST + ORDER NUMBER.
- If your return is accepted, we’ll send you instructions on how and where to send your package. Items sent back to us without first requesting a return will not be accepted.

Paid Import duties and local tax
Once a shipment is processed through customs clearance, customs authorities do not issue refunds on the fees paid. Please note that duties, taxes, or any additional charges incurred will not be refunded by ERL. For any return questions on international orders, you can always contact us at help@erl.studio.
- Refunds. Please note returns can take up to 10 business days to process from arrival at our warehouse. We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within another 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund. If more than 15 business days have passed since we’ve approved your return, please contact us at service.erl.studio.
